Terms & Conditions

Last updated: September 2026 · Alworawa Landscapes & Farm, Rusinga Island, Kenya

1. Acceptance of Terms

By ordering tree seedlings, purchasing fresh farm produce, booking a farm tour, or engaging consulting services from Alworawa Landscapes & Farm ("Alworawa", "we", "us"), you agree to be bound by these Terms and Conditions. If you are acting on behalf of a school, cooperative, or institution, you warrant that you have authority to bind that entity.

2. Tree Seedlings & Follow-up Support

Alworawa produces native and fruit tree seedlings conditioned for Rusinga Island and Lake Victoria basin microclimates:

  • Quality Assurance: Seedlings are hardened in our nursery and inspected for root vigor and disease freedom prior to collection or delivery.
  • Follow-Up Care: We provide planting guidelines and check-in support to help achieve high survival rates. Buyers agree to follow advised watering, spacing, and mulching practices.
  • Bulk Orders: Institutional, church, or community orders exceeding 100 seedlings require a 50% reservation deposit before staging and nursery dispatch.

3. Produce Orders & Delivery

We sell fresh vegetables, sweet potatoes, herbs, and heritage produce harvested from our chemical-free, solar-irrigated model plots:

  • Seasonal Harvests: Produce availability depends on growing seasons. Harvest availability sheets are updated weekly.
  • Collection & Dispatch: Farm gate pickup on Rusinga Island is standard. Deliveries to Mbita, Homa Bay, or Kisumu are subject to agreed logistics fees.
  • Perishable Goods: Any discrepancy in quantity or produce quality must be flagged within 24 hours of receipt.

4. Farm Visits & Safety Guidelines

Alworawa welcomes farmers, student researchers, and community groups for scheduled field days:

  • Advance Booking: All tours must be scheduled in advance (walkthroughs hosted Thursdays and Saturdays). Unannounced entry to nursery propagation zones is prohibited.
  • Working Farm Environment: Visitors must wear closed shoes and exercise caution near solar pumping equipment, water storage tanks, and irrigation drip lines.
  • Supervision: Minors and school groups must be accompanied by teachers or guardians at all times.

5. Knowledge Products & Intellectual Property

Farming guides, manual printouts, site plans, and digital publications created by Alworawa remain the intellectual property of Alworawa Landscapes & Farm. They are provided for personal and community learning. Commercial reproduction or resale without written consent is prohibited.

6. Limitation of Liability

While we share field-tested agronomic practices and high-grade seedlings, crop yields and tree survival depend on climate, rainfall, pest occurrences, and soil management beyond our direct control. Alworawa cannot be held liable for secondary agricultural losses resulting from natural disasters or improper handling after sale.

7. Governing Law

These Terms and Conditions are governed by and construed in accordance with the Laws of Kenya. Any disputes arising in connection with these terms shall be settled amicably or under the jurisdiction of the courts of Kenya.
